Assumption of Risk and Release of All Claims

Warning of Dangerous Conditions: I know that running an ultra-marathon is a potentially hazardous activity, which could cause injury or death. I will not enter and participate unless I am medically able and properly trained, and by my signature, I certify that I am medically able to perform this event, and am in good health, and I am properly trained. I agree to abide by any decision of a race official relative to any aspect of my participation in this event, including the right of any official to deny or suspend my participation for any reason whatsoever. I attest that I have read the rules of the race and agree to abide by them.  I assume all risks associated with running in this event, including but not limited to: falls, physical contact with other participants, volunteers, race personnel, contract service providers, employees, and spectators including the potential contraction of a communicable disease resulting from contact with other participants, volunteers, race personnel, contract service providers, employees, and spectators.  I assume all risks including: the effects of the weather; high heat and/or humidity; freezing cold temperatures; traffic and the conditions of the road including surrounding terrain. 

ASSUMPTION OF RISK: I understand that my access to the Property involves potentially dangerous activities and involves the risk of serious injury, disability, death, and/or property damage. I acknowledge that any injuries that I sustain may result from or be compounded by the actions, omissions, or negligence of The Exchange Running, Inc., its affiliates and each of their shareholders, directors, employees, agents, successors and assigns (the “Releasees”), including negligent emergency response or rescue operations of the Releasees. Notwithstanding the risk, I agree that I am voluntarily accessing and using the participating in the race with knowledge and an express understanding of the danger involved and hereby agree to accept and assume any and all risks of injury, disability, death, and/or property damage arising from such access and use.

WAIVER AND RELEASE OF CLAIMS: BY SIGNING BELOW, I HEREBY EXPRESSLY WAIVE AND RELEASE ANY AND ALL CLAIMS, LOSSES, DAMAGES, EXPENSES, COSTS (INCLUDING ATTORNEY’S FEES), OR LIABILITY (COLLECTIVELY, “CLAIMS”), NOW KNOWN OR HEREAFTER KNOWN, AGAINST THE RELEASEES ARISING OUT OF OR ATTRIBUTABLE TO MY PARTICIPATION IN THE RACE, WHETHER ARISING OUT OF THE ORDINARY NEGLIGENCE OF ANY RELEASEES OR OTHERWISE, INCLUDING BUT NOT LIMITED TO CLAIMS ARISING OUT OF INJURY, DISABILITY, DEATH, OR PROPERTY DAMAGE. I AGREE NOT TO MAKE OR BRING ANY SUCH CLAIM AGAINST ANY RELEASEE, AND FOREVER RELEASE AND DISCHARGE ALL RELEASEES FROM LIABILITY UNDER SUCH CLAIMS. 

BY SIGNING BELOW, i ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE ANY RELEASEE, WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME. I COMPLETELY AND UNCONDITIONALLY RELEASE ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
